Terms and conditions

The owner of the online shop THESTORY.EE (hereinafter referred to as the Online Shop) is Estonian Coffee Roastery OÜ (registration code 16372152), located at Veldi tee 5, Veneküla, Rae parish, Harjumaa 75325.

1. Validity of the sales contract, commercial and price information
1.1 The terms and conditions of sale apply to the purchase of goods from the Online Shop.
1.2 The prices of the products sold in the Online Shop are indicated with the
products. The prices indicated in the Online Shop are in Euro and include VAT.
1.3 The price is subject to a delivery charge (except in special cases and agreements).
1.4 The delivery charge depends on the location of the buyer and the delivery method.
1.5 Information about the Goods is provided on the Online Shop directly with the Goods.

2. Making an order
2.1 In order to place an order, you must add the products you wish to order to your shopping cart.
2.2 To place an order, you must fill in the required fields and select the appropriate delivery method. The amount of the charge in euros will then be displayed on the screen, which can be paid securely by the following payment methods:

- Estonian bank payments: LHV, Swedpank, Luminor, SEB, Coop Pank, Citadele, Pocopay.
- Finnish bank links: Aktia, Alandsbanke, Danske, Hendelsbanke, Oma Säästopankki, Pohjola, POP Pankki, Säästopankki.
- Latvian bank payments: Swedbank, SEB, Citadele, Luminor.
- Visa/Mastercard card payments.
NB: When paying by bank transfer, be sure to press the "Back to merchant" button on the bank page.

2.3 Payments are processed by Maksekeskus AS. Payment is made outside the Online Shop in a secure environment - in the case of payment by bank link in the secure environment of the respective bank and in the case of payment by credit card in the secure environment of the Payment Centre AS. The Seller does not have access to the customer's bank and credit card details. The contract enters into force as from the date of receipt of the amount due in the current account of the Online Shop.
2 .4 The owner of the online shop is the controller of the personal data and forwards the personal data necessary for the execution of payments to the authorised processor Maksekeskus AS.
2.5 If the ordered goods cannot be delivered due to the expiry of the goods or for any other reason, the buyer shall be informed thereof as soon as possible and the money paid (including the costs of delivery of the goods) shall be refunded immediately, but not later than 14 days after the notification is sent.

3. Delivery
3.1 Goods are shipped to the following regions: EU countries
3.2 The buyer has the following options for picking up the goods: DPD parcel terminal, Omniva parcel terminal, Itella parcel terminal.
3.3 The shipping costs are borne by the Buyer and the corresponding price information is displayed with the shipping method.
3.4 Domestic shipments in Estonia will generally arrive at the destination specified by the buyer within 2-5 working days from the date of entry into force of the sales contract.
3.5 In exceptional cases, the right of delivery is granted up to 20 calendar days.
3.6 The Online shop is not liable for the delay in delivery of the goods if the goods have been delivered to the logistics partners in due time, but the delay in delivery is due to circumstances that the Online shop could not influence or foresee.

4. Right of withdrawal
4.1 After receipt of the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days
4.2 The right of withdrawal does not apply if the buyer is a legal person.
4.3 In order to exercise the right of withdrawal within 14 days, the returned products must be intact and undamaged.
4.4 In the event that the goods show signs of use or wear, the Webshop has the right to refuse to take back the goods.
4.5 In order to return the goods, a declaration of withdrawal from the purchase of the goods must be submitted no later than 14 days after receipt of the goods. The application can be found by clicking here: Declaration of withdrawal
4.6 The cost of returning the goods shall be borne by the Buyer, unless the reason for returning the goods is that the goods to be returned do not correspond to the goods ordered (e.g. wrong or defective goods).
4.7 The Buyer must return the goods within 14 days of the date of the application or provide proof that he has delivered the goods to the carrier within the aforementioned period.
4.8 Upon receipt of the goods to be returned, the online shop shall immediately, but no later than 14 days after receipt of the withdrawal request, refund to the buyer all fees received from the buyer under the contract.
4.9 The online shop may refuse to make refunds until it has received the return of the goods that are the subject of the contract or until the buyer has provided proof that it has returned the goods, whichever is the earlier.
4.10 The online shop shall have the right to withdraw from the sales transaction and to demand the return of the goods from the buyer if the price of the goods in the online shop has been marked significantly below the market price of the goods due to a mistake.

5. Right to lodge a complaint
5.1 The online shop shall be liable for the non-conformity or defect of the goods sold to the buyer, which already existed at the time of delivery of the goods, and which occurs within a period of up to two years from the delivery of the goods to the buyer. During the first six months of the delivery of the goods to the buyer, it shall be assumed that the defect already existed at the time of delivery. It is the responsibility of the Online Shop to rebut this presumption.
5.2 In the event of a defect, the Buyer has the right to contact the online shop within two months at the latest by sending an e-mail to
e-pood@eestiparimkohv.ee or by calling +37258587276.
5.3 The online shop is not liable for defects that have occurred after the delivery of the goods to the buyer.
5.4 In the event that the goods purchased from the Webshop have defects for which the Webshop is liable, the Webshop will repair or replace the defective goods. In the event that the goods cannot be repaired or replaced, the Online shop will refund the buyer all the fees that were included in the sales contract.
5.5 The online shop shall respond to the complaint submitted by the consumer in writing or in a form that can be reproduced in writing within 15 days.

6. Liability
6.1 The online shop and the buyer shall be liable for the damage caused to the other party by the breach of these terms and conditions in the cases and to the extent provided for by the legislation in force in the Republic of Estonia.

7. Unquantifiable force
7.1 The Online shop shall not be liable for damage caused or delay in delivery of the goods if the damage or delay in delivery of the goods is caused by circumstances that the Online shop could not influence or foresee.

8. Direct marketing and processing of personal data
8.1 The online shop will use the personal data provided by the buyer (including name, telephone number, address, e-mail address, bank details) only to process the order and send the goods to the buyer.
8.2 The online shop forwards personal data to companies providing transport services in order to deliver the goods.
8.3 The online shop sends newsletters and offers to the buyer's e-mail address only if the buyer has expressed his/her wish to receive such newsletters and offers by entering his/her e-mail address on the website and has indicated his/her wish to receive direct mail notifications.
8.4 The Buyer may opt out of receiving offers and newsletters by e-mail at any time by notifying us by e-mail or by following the instructions in the e-mail containing the offers.

9. Dispute settlement
9.1 If the buyer has any complaints regarding the Online Shop, he/she should send them by e-mail to e-pood@eestiparimkohv.ee or by phone +37258587276.
9.2 If the buyer and the Online Shop are unable to settle the dispute through an agreement, the buyer can turn to the Consumer Disputes Committee. If the consumer cannot agree to the dispute with the consumer's dispute settlement service, the consumer can contact the Consumer Disputes Committee. The Consumer Disputes Committee is competent to settle disputes arising from the contract concluded between the buyer and the Online Shop. The examination of the buyer's complaint by the Commission is free of charge.
9.3 The Buyer may refer to the European Union Consumer Dispute Resolution Platform.
